Why Am I Hearing About FinCEN?

The FinCEN Residential Real Estate Reporting Rule is a federal requirement that applies to certain residential transactions, primarily involving entity buyers and non-financed purchases.

Although the rule is generally triggered based on the structure of the buyer, some transaction details involving the seller may be required to complete the federal report.

    FinCEN reporting is a nationwide federal transparency requirement. It is not an investigation, audit, or indication of concern regarding any party to the transaction.

    Most sellers will experience little to no disruption.

  • Even though the rule is triggered by the buyer’s structure and financing, the federal report must include certain transaction-level information.

    This may include:

    • Confirmation of seller identity

    • Property details

    • Purchase price

    • Closing date
